Beta Platform Notice
FutureFund is currently in beta. Features, yields, and availability may change as we refine the platform. By using our services during this period, you acknowledge that you are using a platform that is still under active development.
1. Acceptance of Terms
By accessing or using the FutureFund platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and FutureFund (Pty) Ltd ("FutureFund", "we", "our", or "us"), a company registered in the Republic of South Africa.
2. Description of Services
FutureFund provides a digital savings platform that enables users to create education savings funds for children. Our services include:
- Conversion of South African Rands (ZAR) into dollar-denominated stablecoins (USDC)
- Deployment of funds into decentralised finance (DeFi) lending and yield protocols to generate returns
- Portfolio management across three risk-adjusted savings plans (Steady, Growth, and High Growth)
- Family contribution features allowing multiple contributors to a single education fund
- Withdrawal processing, converting stablecoins back to ZAR for disbursement
3. Eligibility
To use FutureFund, you must:
- Be at least 18 years of age
- Be a resident of a supported jurisdiction (currently South Africa)
- Possess a valid South African identity document or passport
- Complete our Know Your Customer (KYC) verification process
- Have a valid South African bank account in your own name
We reserve the right to refuse service to any person or entity at our sole discretion, particularly where regulatory requirements cannot be met.
4. Account Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
- Provide accurate and complete information during registration and maintain its accuracy
- Use strong, unique passwords and enable multi-factor authentication where available
- Notify us immediately of any unauthorised access or security breach
- Not share your account credentials with any third party
- Not use the Platform for any unlawful purpose, including money laundering or terrorism financing
5. Fees and Charges
FutureFund may charge the following fees:
- Management fee: A percentage of assets under management, disclosed at the time of plan selection
- Currency conversion fees: Applied when converting between ZAR and USDC, reflecting market rates and processing costs
- Withdrawal fees: Processing fees for converting stablecoins back to ZAR and transferring to your bank account
- Early withdrawal penalties: May apply if funds are withdrawn before the stated savings term, as specified in your plan details
All applicable fees will be clearly disclosed before you confirm any transaction. We reserve the right to modify our fee structure with 30 days' prior notice to affected users.
6. Risks and Disclaimers
By using FutureFund, you acknowledge and accept the following risks:
- Yield variability: Target returns (8%, 11%, 14%) are projections based on historical DeFi protocol performance. Actual returns may be higher or lower and are not guaranteed.
- Smart contract risk: Funds deployed to DeFi protocols are subject to smart contract risk. While we use only audited, established protocols, the possibility of exploits or bugs cannot be entirely eliminated.
- Currency risk: While dollar-denominated savings protect against ZAR depreciation, the ZAR/USD exchange rate at the time of withdrawal may differ from the rate at deposit.
- Regulatory risk: Changes in South African or international regulations governing crypto assets could affect our ability to offer certain services.
- Stablecoin risk: While USDC maintains a strong track record of dollar peg stability, stablecoins carry inherent risks related to their reserve management and issuer solvency.
FutureFund is not a bank and deposits are not covered by bank deposit insurance. Past performance of DeFi protocols does not guarantee future results.
7. Intellectual Property
All content, trademarks, logos, and intellectual property on the Platform are owned by FutureFund (Pty) Ltd or its licensors. You may not reproduce, distribute, modify, or create derivative works from any Platform content without our prior written consent. Your use of the Platform does not grant you any ownership rights in our intellectual property.
8. Limitation of Liability
To the maximum extent permitted by South African law, FutureFund shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from your use of or inability to use the Platform. Our total liability for any claim arising from these Terms or your use of the Platform shall not exceed the total fees paid by you to FutureFund in the twelve months preceding the claim.
9. Termination
We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, if required by law or regulation, or if we cease to offer services in your jurisdiction. Upon termination, we will make reasonable efforts to allow you to withdraw your funds, subject to applicable fees and regulatory requirements. You may close your account at any time by contacting our support team.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any dispute arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa.
Before initiating any legal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation. If a dispute cannot be resolved within 30 days of written notice, either party may pursue formal legal remedies.
11. Changes to These Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Platform at least 30 days before they take effect. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the updated Terms.
